Le 15 novembre 2005, des négociateurs d'Israël et de l'Autorité palestinienne ont conclu un accord sur les mouvements et l'accès depuis et vers Gaza Les négociations ont été facilitées par la secrétaire d'Etat américaine Condoleezza Rice, le haut représentant de l'Union européenne pour la politique étrangère et de sécurité commune Javier Solana et l'envoyé de la communauté internationale pour le désengagement israélien de Gaza, James Wolfensohn.

Les détails de l'accord sont contenus dans deux documents - l'Accord sur le mouvement et l'accès, et les Principes convenus pour le passage de Rafah.

 

  • Accord sur les mouvements et l'accès

Afin de promouvoir le développement économique pacifique et d'améliorer la situation humanitaire sur le terrain, l'accord suivant a été conclu.

Il représente les engagements du Gouvernement israélien (Goi) et de l'Autorité palestinienne (AP). Sa mise en œuvre et son élaboration seront appuyées par l'Envoyé spécial du Quatuor pour le désengagement et son personnel et / ou le Coordonnateur de la sécurité des États-Unis (USSC) et son personnel.


Rafah
Les parties ont accepté la déclaration de principes ci-jointe.

Rafah sera ouvert dès qu'il sera prêt à fonctionner selon une norme internationale conformément aux spécifications de la présente entente et dès que la tierce partie sera sur place, avec une date cible du 25 novembre.

 

Points de croisement

Les parties sont convenues que:

Les passages fonctionneront en continu. Rapidement, Israël permettra l'exportation de tous les produits agricoles de Gaza au cours de la saison de récolte de 2005.

Le nouveau scanner sera installé et opérationnel d'ici le 31 décembre. À cette date, le nombre de camions d'exportation par jour à traiter via Karni atteindra 150 et 400 d'ici la fin 2006. Un système de gestion commun sera adopté par les deux parties.

En plus du nombre de camions ci-dessus, Israël permettra l'exportation de produits agricoles à partir de Gaza et facilitera sa sortie et sa progression rapide afin que la qualité et la fraîcheur puisse être maintenue. Israël assurera la possibilité continue d'exporter.

Pour améliorer le fonctionnement, les parties conviennent que:

- Lorsqu'une nouvelle génération d'appareils de radiographie capable de scanner les remorques ainsi que les conteneurs est disponible, elle sera utilisée. Une fois arrivé dans le pays, des essais seront également effectués avec l'aide de l'Envoyé spécial du Quatuor.

- L'USSC veillera à la poursuite des consultations, et les questions de mise en œuvre non résolues seront discutées avec les parties.

- L'Autorité palestinienne veillera à ce que les passages soient protégés du côté palestinien de la frontière et formera et améliorera la gestion de tous les passages pour assurer l'efficacité et l'efficience. L'AP établira sans délai un système unifié de gestion des frontières.

- Le système de gestion qui a été développé pour Karni devrait, avec des variations locales appropriées, être adapté aux passages d'Erez et de Kerem Shalom. Israël s'engage également à mettre en place, le cas échéant, des arrangements similaires qui rendront les départements de la Cisjordanie pleinement opérationnels dès que possible. Un comité bilatéral, avec la participation au besoin de l'Envoyé spécial du Quatuor et / ou de l'USSC, élaborera des procédures opérationnelles pour ces passages.

 

Lien entre Gaza et la Cisjordanie

Israël permettra le passage des convois pour faciliter les mouvements de marchandises et de personnes. Plus précisément:

- Établir des convois d'autobus avant le 15 décembre.

- Établir des convois de camions avant le 15 janvier.

- Élaborer des modalités détaillées de mise en œuvre au sein d'un comité bilatéral du GdI et de l'AP avec la participation nécessaire de l'équipe du Quatuor et de l'USSC.

 

Il est entendu que la sécurité est une préoccupation première et permanente pour Israël et que des dispositions appropriées pour assurer la sécurité seront adoptées.


Mouvement en Cisjordanie

Conformément aux besoins de sécurité d'Israël, pour faciliter la circulation des personnes et des marchandises en Cisjordanie et pour minimiser les perturbations de la vie palestinienne, les travaux en cours entre Israël et les États-Unis pour établir une liste convenue d'obstacles à la circulation et élaborer un plan pour les réduire. La mesure maximale possible sera accélérée afin que les travaux puissent être achevés d'ici le 31 décembre.


Port de Gaza

La construction d'un port maritime peut commencer. Le GoI s'engage à assurer aux donateurs qu'il n'interférera pas avec l'exploitation du port. Les parties mettront en place un comité tripartite dirigé par les États-Unis pour élaborer des mesures de sécurité et d'autres arrangements pertinents pour le port avant son ouverture. Le modèle de troisième partie à utiliser à Rafah fournira la base de ce travail.

 

Aéroport
Les parties conviennent de l'importance de l'aéroport. Les discussions se poursuivront sur les questions de sécurité, de construction et d'exploitation.

Général
Rafah sera opéré par l'Autorité palestinienne de son côté, et l'Égypte de son côté, conformément aux normes internationales, conformément à la loi palestinienne et sous réserve des termes de cet accord.

Rafah sera ouvert dès qu'il sera prêt à fonctionner selon une norme internationale conformément aux spécifications de la présente entente et dès que la tierce partie sera sur place, avec une date cible du 25 novembre.

 

L'utilisation de la traversée de Rafah sera réservée aux détenteurs de carte d'identité palestinienne et à d'autres personnes, par exception, dans les catégories convenues avec une notification préalable au GdI et l'approbation des hauts responsables de l'AP.
L'AP notifiera le GoI 48 heures avant le franchissement d'une personne dans les catégories exceptées - diplomates, investisseurs étrangers, représentants étrangers d'organisations internationales reconnues et cas humanitaires.


Le GoI répondra dans les 24 heures avec toutes objections et inclura les raisons des objections;
L'AP avisera le GoI de sa décision dans les 24 heures et inclura les motifs de sa décision;
La tierce partie veillera à ce que les procédures appropriées soient suivies et informera les deux parties de toute information en sa possession concernant les personnes qui font une demande de franchissement en vertu de ces exceptions.


Ces procédures demeureront en vigueur pendant une période de 12 mois, à moins que la tierce partie ne rende une évaluation négative de l'Autorité palestinienne qui assure la liaison de Rafah. Cette évaluation se fera en étroite coordination avec les deux parties et tiendra dûment compte de l'opinion des deux parties.


Rafah sera également utilisé pour l'exportation de marchandises en Egypte.

Des critères objectifs pour l'inspection des wagons seront établis par consensus. Les critères sont les suivants:

L'équipement de recherche sera installé, y compris

- Lumières noires

- Outils électriques et compresseur pour les outils

- Technologie à convenir, comprenant éventuellement l'imagerie sonore, la détection gamma (véhicule complet ou à main) et / ou l'imagerie à ondes millimétriques

- Miroirs et alésage équipement de portée pour rechercher des endroits difficiles à atteindre


Le personnel sera formé à la recherche de véhicules et à l'utilisation de cet équipement par la tierce partie aux normes internationales.

Des caméras seront installées pour surveiller le processus de recherche.
Le tiers évaluera la capacité de l'AP à inspecter les voitures selon ces critères et selon les normes internationales. Une fois que la PA développera la capacité d'inspecter les voitures à la satisfaction de la 3ème partie, les voitures seront autorisées à passer par Rafah. Jusqu'à ce moment, les voitures passeront à titre exceptionnel, sous réserve des spécifications convenues dans le protocole de sécurité.

 

Rafah sera le seul point de passage entre la bande de Gaza et l'Egypte (à l'exception de Kerem Shalom pour la période convenue).

 

L'AP établira des procédures d'exploitation claires.

Jusqu'à ce que Rafah soit opérationnel, l'Autorité palestinienne ouvrira la frontière de Rafah sur une base ad hoc pour les pèlerins religieux, les patients médicaux, et d'autres, en coordination avec le bureau du général Gilad du côté israélien.

Israël fournira à l'Autorité palestinienne toutes les informations nécessaires pour mettre à jour le registre de la population palestinienne, y compris toutes les informations sur les titulaires de carte d'identité palestinienne qui se trouvent actuellement à l'extérieur du pays.
Un bureau de liaison, dirigé par le tiers, recevra en temps réel des vidéos et des données sur les activités à Rafah et se réunira régulièrement pour examiner la mise en œuvre de cet accord, résoudre les différends découlant de cet accord et accord.

 

Sécurité

L'Autorité palestinienne agira pour empêcher le déplacement d'armes et d'explosifs au point de passage de Rafah.

L'AP établira les limites de bagages pour chaque passager dans le cadre des procédures. Les limites seront les mêmes que celles actuellement appliquées par le GoI; Très fréquents voyageurs (politique de la valise) à convenir.

Les voyageurs, y compris les résidents de retour, peuvent utiliser le point de passage pour apporter des effets personnels tels que définis à la règle 1 e) de la rubrique 7 de l'annexe du Tarif des douanes en vigueur. Tout autre objet personnel ou autre est dédouané au point de passage de Kerem Shalom.

L'AP fournira au tiers une liste des noms des travailleurs au poste de Rafah qui sera partagée avec les Israéliens. L'AP prendra en compte les préoccupations des Israéliens.

Les services de sécurité israéliens, palestiniens, américains et égyptiens continueront de se coordonner sur les questions de sécurité et participeront au groupe de travail sur la sécurité.
Au cas par cas, l'Autorité palestinienne prendra en considération les informations concernant les personnes concernées fournies par le Goi. L'AP consultera le GoI et le tiers avant que l'Autorité palestinienne prenne la décision d'interdire le voyage ou non. Au cours de cette consultation, qui ne prendra pas plus de six heures, la personne en question ne sera pas autorisée à traverser.

 

Douane
GoI et PA continueront d'appliquer le Protocole de Paris du 29 avril 1994.
Rafah sera exploité conformément aux normes et règles internationales et au Protocole de Paris. Le GdI et l'AP s'accordent sur une coopération et un partage d'informations aussi larges que possible. GoI et PA collaboreront sur les questions de formation.
Les douanes de GoI et de PA tiendront des réunions régulières auxquelles le GE sera invité, le cas échéant.

 

Kerem Shalom

Les agents des douanes de l'AP vont nettoyer le fret entrant à Kerem Shalom sous la surveillance d'agents des douanes israéliens. Les deux parties discuteront plus tard des procédures opérationnelles. Les opérations à Kerem Shalom assureront la formation et le renforcement des capacités du personnel des douanes de l'AP.Le tiers examinera la capacité douanière de l'Autorité palestinienne dans 12 mois et fera une recommandation aux deux parties pour une décision conjointe concernant les arrangements futurs. En cas de désaccord, les États-Unis, en consultation avec le GoI, l'AP et le tiers, régleront la question rapidement.


Tierce personne

La tierce partie aura le pouvoir de s'assurer que l'AP respecte toutes les règles et réglementations applicables concernant le point de passage de Rafah et les termes de cet accord. En cas de non-conformité, le tiers a le pouvoir d'ordonner le réexamen et la réévaluation de tout passager, bagage, véhicule ou bien. Pendant le traitement de la demande, la personne, les bagages, le véhicule ou le fret en question ne seront pas autorisés à quitter les locaux du point de passage de Rafah.

La tierce partie aidera l'Autorité palestinienne à renforcer les capacités - formation, équipement et assistance technique - sur la gestion des frontières et les douanes.
Le détail du rôle de la tierce partie est précisé dans le mémorandum d'accord ci-joint.
La troisième partie sera l'Union européenne.

 

Agreed documents on movement and access from and to Gaza

 

On November 15, 2005, negotiators from Israel and the Palestinian Authority achieved an agreement on movement and access from and to Gaza

The negotiations were facilitated by US Secretary of State Condoleezza Rice, European Union High Representative for the Common Foreign and Security Policy Javier Solana and the international community's envoy for the Israeli disengagement from Gaza, James Wolfensohn.

The details of the agreement are contained in two documents - Agreement on Movement and Access, and Agreed Principles for Rafah Crossing.

Agreement on Movement and Access

To promote peaceful economic development and improve the humanitarian situation on the ground, the following agreement has been reached. It represents the commitments of the Government of Israel (GoI) and the Palestinian Authority (PA). Its implementation and further elaboration will be assisted by the Quartet Special Envoy for Disengagement and his staff and/or the United States Security Coordinator (USSC) and his staff.

Rafah

The parties have agreed to the attached statement of principles. Rafah will be opened as soon as it is ready to operate at an international standard in accordance with the specifications of this agreement and as soon as the 3rd party is on site, with a target date of November 25.

Crossing Points

The parties have agreed that:

The passages will operate continuously. On an urgent basis, Israel will permit the export of all agricultural products from Gaza during this 2005 harvest season.

The new and additional scanner will be installed and fully operational by December 31. At that time, the number of export trucks per day to be processed through Karni will reach 150, and 400 by end-2006. A common management system will be adopted by both parties.

In addition to the number of trucks above, Israel will permit export of agricultural produce from Gaza and will facilitate its speedy exit and onward movement so that quality and freshness can be maintained.  Israel will ensure the continued opportunity to export.

To enhance operation, the parties agree that:

- When a new generation of x-ray equipment able to scan trailers as well as containers becomes available it will be used.  Once it arrives in the country, testing will also be carried out with the assistance of the Quartet Special Envoy.

- The USSC will ensure continuing consultation, with unresolved implementation issues to be discussed as needed with the parties.

- The PA will ensure that the passages will be protected on the Palestinian side of the border and will train and upgrade the management of all crossings to ensure efficiency and effectiveness. The PA will establish, without delay, a unified system of border management.

- The management system that has been developed for Karni should, with suitable local variations, be adapted to the passages at Erez and Kerem Shalom.  Israel also undertakes to put in place similar arrangements as appropriate that will make West Bank passages fully operational as soon as possible.  A bilateral committee, with participation as needed of the Quartet Special Envoy and/or the USSC, will develop operational procedures for those passages.
 
Link between Gaza and the West Bank

Israel will allow the passage of convoys to facilitate the movements of goods and persons. Specifically:

- Establish bus convoys by December 15.

- Establish truck convoys by January 15.

- Work out detailed implementation arrangements in a bilateral committee of the GoI and PA with participation as needed from the Quartet team and the USSC.

It is understood that security is a prime and continuing concern for Israel and that appropriate arrangements to ensure security will be adopted.

Movement within the West Bank

Consistent with Israel's security needs, to facilitate movement of people and goods within the West Bank and to minimize disruption to Palestinian lives, the ongoing work between Israel and the U.S. to establish an agreed list of obstacles to movement and develop a plan to reduce them to the maximum extent possible will be accelerated so that the work can be completed by December 31.

Gaza Seaport

Construction of a seaport can commence. The GoI will undertake to assure donors that it will not interfere with operation of the port. The parties will establish a U.S.-led tripartite committee to develop security and other relevant arrangements for the port prior to its opening. The 3rd party model to be used at Rafah will provide the basis for this work.

Airport

The parties agree on the importance of the airport. Discussions will continue on the issues of security arrangements, construction, and operation.
 


Agreed Principles for Rafah Crossing

To be supplemented prior to opening by agreements on security, customs and 3rd party implementation procedures

General

Rafah will be operated by the Palestinian Authority on its side, and Egypt on its side, according to international standards, in accordance with Palestinian law and subject to the terms of this agreement.

Rafah will be opened as soon as it is ready to operate at an international standard in accordance with the specifications of this agreement and as soon as the 3rd party is on site, with a target date of November 25.

Use of the Rafah crossing will be restricted to Palestinian ID card holders and others by exception in agreed categories with prior notification to the GoI and approval of senior PA leadership.

The PA will notify the GoI 48 hours in advance of the crossing of a person in the excepted categories-diplomats, foreign investors, foreign representatives of recognized international organizations and humanitarian cases.

The GoI will respond within 24 hours with any objections and will include the reasons for the objections;

The PA will notify the GoI of their decision within 24 hours and will include the reasons for their decision;

The 3rd party will ensure the proper procedures are followed and will advise both sides of any information in its possession pertaining to the people applying to cross under these exceptions.

These procedures will remain in place for a period of 12 months, unless the 3rd party delivers a negative evaluation of the PA running the Rafah crossing. This evaluation will be done in close coordination with both sides and will give due consideration to the opinion of both sides.

Rafah will also be used for export of goods to Egypt.

Objective criteria for the inspection of cars will be established by consensus. The criteria are as follows:

Search equipment will be installed, including

- Black lights

- Power tools and a compressor for the tools

- Technology to be agreed, possibly including sonic imagery, gamma detection (full vehicle or hand held), and/or millimetre wave imagery

- Mirrors and bore scope equipment to search hard to reach places

Personnel will be trained to search vehicles and on the use of this equipment by the 3rd party to international standards.

Cameras will be installed to monitor the search process.

The 3rd party will evaluate the capacity of the PA to inspect cars according to these criteria and to international standards. Once the PA develops the capacity to inspect cars to the satisfaction of the 3rd party, cars will be allowed to pass through Rafah. Until that time, cars will pass through on an exceptional basis, subject to specifications agreed in the security protocol.

Rafah will be the only crossing point between the Gaza Strip and Egypt (with the exception of Kerem Shalom for the agreed period).

The PA will establish clear operating procedures.

Until Rafah is operational, the PA will open Rafah crossing on an ad hoc basis for religious pilgrims, medical patients, and others, in coordination with General Gilad's office on the Israeli side.

Israel will provide the PA with all information needed to update the Palestinian population registry, including all information on Palestinian ID card holders who are currently outside the country.

A liaison office, led by the 3rd party, will receive real-time video and data feed of the activities at Rafah and will meet regularly to review implementation of this agreement, resolve any disputes arising from this agreement, and perform other tasks specified in this agreement.
Security

The PA will act to prevent the movement of weapons and explosives at the Rafah crossing.

The PA will establish baggage limits for each passenger as part of the procedures. Limits will be the same as currently applied by the GoI; very frequent travellers (suitcase policy) to be agreed.

Travellers, including returning residents, may use the crossing point to bring in personal effects as defined in Rule 1(e) to Heading 7 of the Annex to the prevailing Customs Tariff. Any other personal belongings or other goods shall be cleared at the Kerem Shalom crossing point.

The PA will provide the 3rd party a list of names of the workers at Rafah crossing which will be shared with the Israelis. The PA will take the Israelis concerns into account.

Security services from Israel, PA, the U.S., and Egypt will continue to coordinate on security issues and will participate in the security working group.

On a case by case basis, the PA will consider information on persons of concern provided by the GoI. The PA will consult with the GoI and the 3rd party prior to the PA making a decision to prohibit travel or not. During this consultation, which will not take more than six hours, the person in question will not be permitted to cross.

Customs

GoI and PA will continue to apply the Paris Protocol of 29 April 1994.

Rafah will be operated according to international standards and rules and the Paris Protocol.

GoI and PA agree on widest possible co-operation and information sharing.

GoI and PA will co-operate on training issues.

GoI and PA customs will hold regular meetings to which the GoE will be invited as appropriate.

Kerem Shalom

PA customs officials will clear incoming cargo at Kerem Shalom under the supervision of Israeli customs agents.

Both sides will discuss operating procedures at a later stage.

Operations at Kerem Shalom will provide training and capacity building to PA customs staff.

The 3rd party will review the PA's customs capacity in 12 months and make a recommendation to both sides for a joint decision regarding future arrangements. In the event of a disagreement, the U.S., in consultation with the GoI, the PA, and the 3rd party, will resolve the issue expeditiously.

Third party

The 3rd party will have the authority to ensure that the PA complies with all applicable rules and regulations concerning the Rafah crossing point and the terms of this agreement. In case of non-compliance the 3rd party has the authority to order the re-examination and reassessment of any passenger, luggage, vehicle or goods. While the request is being processed, the person, luggage, vehicle or cargo in question will not be allowed to leave the premises of the Rafah crossing point.

The 3rd party will assist the PA to build capacity - training, equipment and technical assistance - on border management and customs.

Details of the 3rd party's role are specified in the attached memorandum of understanding.

The 3rd party will be the European Union.
